Terms and Conditions

Article 1 - Definitions
In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period during which the consumer may exercise the right of withdrawal;
  • Consumer: a natural person who is not acting for the purpose of a profession or business and concludes a distance contract with the entrepreneur;
  • Day: calendar day;
  • Duration transaction: a distance contract related to a series of products and/or services where the obligation to deliver and/or purchase is spread over time;
  • Durable support: any medium that allows the consumer or entrepreneur to store information personally addressed to them so that it can be consulted in the future and reproduced unchanged;
  • Right of withdrawal: the right of the consumer to cancel the distance contract within the cooling-off period;
  • Entrepreneur: Allora Group Limited, the natural or legal person offering products and/or services to consumers at a distance;
  • Distance contract: a contract in which, within an organized system for distance selling of products and/or services, the contract is concluded exclusively through one or more distance communication techniques;
  • Distance communication technique: any method that can be used to conclude a contract without the consumer and entrepreneur being in the same room at the same time;
  • General conditions: these general terms and conditions of the entrepreneur.

Article 3 - Applicability
These general terms and conditions apply to all offers made by the entrepreneur and to all distance contracts and orders concluded between the entrepreneur and the consumer.

Before concluding a distance contract, the text of these general terms will be made available to the consumer. If this is not reasonably possible, it will be indicated that the general terms and conditions are available at the entrepreneur’s premises and will be sent to the consumer free of charge as soon as possible upon request.

If the contract is concluded electronically, contrary to the previous paragraph, and before the conclusion of the distance contract, the text of these general conditions may be made available electronically so that it can be easily stored by the consumer on a durable data medium. If this is not reasonably possible, it will be indicated where the general terms can be consulted electronically and that they will be sent electronically or otherwise free of charge upon request.

If, in addition to these general terms, specific product or service conditions apply, the second and third paragraphs will apply mutatis mutandis, and in the event of a conflict between the general terms and specific product conditions, the consumer may always rely on the provision that is most favorable to them.

If one or more provisions of these general terms and conditions are deemed void or unenforceable at any time, the contract and the remaining provisions of these general terms and conditions shall remain in full force and effect, and the void provision shall be replaced by a provision that most closely matches the original intent.

Article 4 - The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.

The offer is non-binding. The entrepreneur has the right to modify and adapt the offer.

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to make an adequate assessment of the offer. If the entrepreneur uses images, these will accurately represent the products and/or services offered. Obvious errors or mistakes in the offer do not bind the entrepreneur.

All images, specifications, and data in the offer are indicative and cannot be a reason for compensation or cancellation of the contract.

Product images are a faithful representation of the products offered. The entrepreneur cannot guarantee that the colors displayed on the monitor exactly match the actual colors of the products.

Each offer contains information that makes it clear to the consumer what their rights and obligations are upon acceptance of the offer. This concerns particularly:

  • The price, excluding customs duties and import VAT. These additional costs will be borne and are the risk of the customer. The postal or courier service will use the special regulation for postal and courier services regarding imports. This regulation applies when the goods are imported into the destination EU country.
  • Any shipping fees.
  • The methods of concluding the contract and the actions necessary for this.
  • The applicability or non-applicability of the right of withdrawal.
  • Payment methods, delivery, and execution of the contract.
  • The period of validity of the offer or the period during which the price is guaranteed.
  • The level of communication cost for the distance communication technique if the costs of using the communication technique differ from the regular base rate for the communication method used.
  • Whether the contract will be archived after its conclusion, and if so, how it can be accessed by the consumer.
  • How the consumer can check and, if desired, correct the data provided for the contract before concluding the contract.
  • Languages other than English in which the contract can be concluded.
  • The codes of conduct to which the entrepreneur is subject and how the consumer can electronically consult these codes of conduct.
  • The minimum duration of the distance contract in case of a duration transaction. Optional: Available sizes, colors, types of materials.

Article 5 - The Contract
Subject to the provisions of paragraph 4, the contract enters into force when the consumer accepts the offer and meets the conditions set forth.

If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm the receipt of the acceptance electronically. Until the receipt of such acceptance is confirmed, the consumer may withdraw from the contract.

If the contract is concluded electronically, the entrepreneur must adopt adequate technical and organizational measures to protect the electronic transfer of data and ensure a secure web environment.

Article 6 - Right of Withdrawal
The consumer has the right to withdraw from the contract within 14 days without providing any reason. The withdrawal period begins the day after the consumer receives the product.

The consumer must handle the product and its packaging with care during the withdrawal period. If the consumer exercises the right of withdrawal, they must return the product to the entrepreneur in its original condition and packaging.

Article 7 - Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, the return shipping costs are at the consumer’s expense.

If the consumer has paid for the product, the entrepreneur will refund the amount as soon as possible, but no later than 14 days from the date of withdrawal.

Article 8 - Exclusion of the Right of Withdrawal
The entrepreneur may exclude the right of withdrawal for products described in Article 6(2) and (3). This exclusion is valid only if the entrepreneur has explicitly indicated it in the offer or before the conclusion of the contract.

Article 9 - The Price
The price of the products is fixed and inclusive of VAT. Any price increase after the conclusion of the contract must comply with the laws and regulations of the country of sale.

Article 10 - Compliance and Warranty
The entrepreneur guarantees that the products are in conformity with the contract, the specifications in the offer, and applicable legal requirements.

Article 11 - Delivery and Execution
The entrepreneur commits to delivering the products within 30 days unless another time frame is agreed upon.

Article 12 - Duration of Transactions: Duration, Termination, and Extension
The consumer can cancel the contract at any time, provided they follow the agreed cancellation procedures.

Article 13 - Payment
The amounts owed by the consumer must be paid within 7 business days from the start of the reflection period.

Article 14 - Complaints Procedure
Complaints regarding the execution of the contract must be submitted to the entrepreneur within 7 days.

Article 15 - Disputes
These terms and conditions are governed exclusively by the laws of Germany. Any disputes will be subject to the jurisdiction of the courts in Germany.
